Supplemental terms. These Beta Terms apply only to Estimates Beta and supplement the BidPointX Terms of Service and Privacy Policy you accept during signup. If there is a conflict, these Beta Terms control for Estimates Beta.
Beta program. Estimates Beta is a pre release service. Features, availability, and performance can change at any time, and the beta may be paused or discontinued.
Eligibility and accounts. You must provide accurate account and workspace information and keep your contact details current. You are responsible for all activity under your credentials and for maintaining the confidentiality of passwords and access tokens.
License to use. BidPointX grants you a limited, non exclusive, non transferable, revocable license to access and use Estimates Beta for your internal business purposes during the beta period, subject to these Beta Terms and the BidPointX Terms of Service.
Suspension, termination, and revocation. BidPointX may suspend or terminate access to Estimates Beta, revoke the license to use it, or limit features at any time, with or without notice, as permitted by law. This may occur for operational, security, legal, compliance, supportability, or beta management reasons, and to protect BidPointX, users, and third parties.
Service availability. Estimates Beta is provided on an “as is” and “as available” basis. BidPointX does not guarantee uptime, error free operation, or that the service will be available at any particular time or in any particular location.
Your content and inputs. You retain ownership of the content you submit to the service. You grant BidPointX a worldwide license to host, store, reproduce, process, transmit, and display your content solely to operate, maintain, secure, and improve the service and provide support.
Usage data and analytics. BidPointX may collect and use service usage, device, and diagnostic data to operate, secure, support, and improve the service, including to develop new features. BidPointX may create and use aggregated and de identified data for analytics and product improvement, consistent with the Privacy Policy and your selections during signup.
Communications. BidPointX may send you service related messages, including beta updates, security notices, and launch communications. Marketing preferences are handled separately through your user agreement settings.
Feedback. If you provide ideas, suggestions, or feedback, you grant BidPointX a perpetual, irrevocable, royalty free license to use it for any purpose without restriction or compensation.
Acceptable use. You will not misuse the service. This includes attempting unauthorized access, interfering with service operation, reverse engineering except as permitted by law, using the service to infringe rights, or using the service to transmit unlawful, harmful, or abusive content.
Security. You are responsible for securing your devices and accounts. BidPointX may implement security controls, rotate keys, require additional verification, or restrict access when risk is detected.
Third party services. Estimates Beta may integrate with third party services. BidPointX is not responsible for third party products and their terms, and third party services may change or become unavailable.
Intellectual property. Estimates Beta and all related software, designs, and documentation are owned by BidPointX and its licensors. No rights are granted except those expressly stated in these Beta Terms.
Data retention. BidPointX may retain or delete beta data as part of operating the beta, subject to legal requirements and the Privacy Policy. You are responsible for exporting and backing up any data you need.
No warranties. To the maximum extent permitted by law, BidPointX disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.
Limitation of liability. To the maximum extent permitted by law, BidPointX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to Estimates Beta.
Indemnity. To the maximum extent permitted by law, you agree to defend and indemnify BidPointX from claims arising out of your use of Estimates Beta, your content, or your violation of these Beta Terms or applicable law.
Billing notice. Estimates Beta is free during the beta period. Paid plans, if offered, begin only after launch and after you select a plan. BidPointX expects to provide notice approximately 1 to 2 months before launch.
Changes. BidPointX may update these Beta Terms from time to time. Continued use of Estimates Beta after an update means you accept the updated Beta Terms.
